Brachial Plexus Injuries
The brachial plexus nerves run from the spine through the shoulder and into the arm. They control the movement of the shoulder, arm, hand and fingers. When a baby’s shoulder becomes lodged behind the mother’s pubic bone (shoulder dystocia) during the birth process, the brachial plexus can be injured. Injuries such as these can be the result of medical malpractice. At the San Jose birth injury law firm of Corsiglia McMahon & Allard, L.L.P., we are experienced in handling birth injury cases involving brachial plexus injuries. We fight to ensure you are properly compensated for the injury to your child and that you have the resources you need to help your child recover.Brachial Plexus Injury Lawsuits in San Jose, CA
Injuries to the brachial plexus are one of the more common types of birth injuries. These injuries can occur in a number of different ways during childbirth including:
- Pulling on the baby’s head or neck to get the shoulders to pass throughout the birth canal (including using a vacuum or forceps)
- Pulling on the baby’s shoulders during childbirth
- Pulling on the baby’s arms during a breech birth
Depending on where the nerve is affected, the resulting symptoms can vary. If both the upper and lower arm are affected it is known as a condition called Erb’s Palsy. If the hand is paralyzed, then the child has what is known as Klumpke paralysis. Some injuries only affect the upper arm. Most types of brachial plexus injury will require some form of medical intervention whether it is physical and occupational therapy or surgery.
The costs for the medical interventions needed to help a child with a brachial plexus injury (BPI) can quickly add up. If your child's injury was caused by medical negligence, the parents should not have to be responsible for all of the costs. Our attorneys work with parents dealing with birth injuries. We strongly advocate for our clients’ rights to compensation for injuries to their child that could have been prevented.
