Loophole in Medical Board Licensing Allows Physicians to Still Practice After Surrendering License

DoctorThere are many ways that physicians can lose their licenses to practice in a certain state -- many of those who have surrendered their license have illegally prescribed or sold opioids, made errors during surgery, had sex with their patients, or were accused of causing the wrongful death of a patient. A recent investigation stirred up some disturbing information about doctors who still practice medicine, even after they surrendered their medical licenses. How can this happen, you may ask? Yearlong Investigation Reveals Dangerous Doctors Are Still Practicing

An investigation conducted by the Milwaukee Journal Sentinel, USA Today, and MedPage Today has concluded that many physicians all over the country have avoided disciplinary action for mistakes and are still practicing medicine -- just in other states. The investigation states that at least 500 doctors who were publicly disciplined, reprimanded or banned from practicing by one state medical board were still able to obtain a clean medical license from another state medical board. This poses concerns for physicians and patients alike.

Patients Have Limited Access to Their Doctor’s Past History

Even more troubling, these physicians who are still practicing, even though they should not be, have managed to keep their secret, putting many patients at risk. In order for a patient to look up information about a physician, they must access the state’s medical board website. Medical boards and licensing are two of the many things that are left up to states to decide, meaning there are many differences when it comes to the separate state boards. While a doctor has information about his or her transgressions in one state, the state in which they are currently practicing may not have that information on its website.
